Types of TAPU in Turkey?

You need to be aware of several crucial and fundamental facts regarding the title deed or tapu in Turkey, their various types, and the qualities and traits of each type if you wish to purchase real estate there.

Red Tapu in Turkey

The red tapu in Turkey involves all types of built real estate including houses, condos, townhomes, retail spaces, and commercial real estate. Yet, we can find different categories in this title deed according to the ownership form.

Shared title deed

A partnership structure between several owners of the same property serves as the foundation for this kind of ownership. It is the right to own real estate for a set period each year, allowing each of these owners to hold the property for an endless period, with a minimum ownership duration of seven days. The owner of the property has full ownership rights, including the ability to sell, lease, and assign the property to others.

Easement bond

They are the title deeds that separately identify each portion of the property so that a suitable project can be planned for construction on a designated plot of land, approved for construction, and then divided into separate portions, such as apartments within a building. Without taking into account whether the project has been started or not, a special deed is organized for each piece of the real estate, indicating the location of the independent division and its details. After constructing on the site and receiving dwelling approval, title deeds are assigned to it.

Each owner of this land receives an easement deed, which includes details on the location, size, and requirements of the construction, before receiving his or her tapu in Turkey, which is a sort of document that demonstrates the owner’s complete ownership of the property.

Full title deed

This type of Tapu in Turkey is also known as the “Kat Mülkiyeti” in Turkish. It is a document that certifies the bondholder’s ownership over the independent section in the building. Moreover, it designates the independent sections in the real estate after the entire  establishment of the building. Each section is organized for its full title deed.

Blue Title deed in Turkey

This type of title deed includes agricultural sites with dual-use permits for construction and farming. This Tapu, also known as “Arsa” in Turkish, is given to properties that have been set aside for building or investment as part of the city’s organizational plans, and it allows the landowner to erect structures there with the help of a special permit from the municipality to which the property belongs.

Benefits of TAPU

The Tapu in Turkey serves as the property’s official identification when you own a piece of real estate regardless of its type. When the Land Registry Directorate approves this document, the ownership of the property is formal. This document is also necessary for several official government departments, during the processes of real estate-related transactions, including purchasing and selling. There is no minimum or maximum number of owners or participants in a single property.

In this context, it is important to note that if you own a property in which you have partners or a percentage of the property, you can specify in the title deed each partner’s share. which means that there is no specific portion of the property to a particular person. When a foreigner purchases real estate in Turkey, he can apply for a “real estate residence permit” that he can also grant to his wife and children. Only one person can get the title deed document. It contains specific information about each owner’s share.
