The presidential cabinet decided previously on April 12th, 2022 to make an amendment to the Turkish Citizenship application by real estate. On the evening of May 12, 2012, the Turkish presidency published in the official gazette the decree number 5554 amending Article 46 of Turkish Citizenship Law No. 5901.
The Decree also includes an official decision to raise the investment value required to get Turkish citizenship through the real estate from 250,000 to 400,000 dollars. Yet, the General Directorate of Land Registry and Cadastre published the application conditions of the new regulation on 01/06/2022.
The conditions of the Turkish Citizenship application’s new regulation
Requirement of Turkish Citizenship application for 250,000$
The statement explains that the directorate will consider certain applications over a value of 250,000$. Therefore, foreign buyers should apply in person, via Alo 180, or WebTapu until 24:00 of 12/06/2022. However, the application made through the website https://randevu.tkgm.gov.tr/tr/Appointment/eAppointmentStart will not be accepted due to the inability to enter the party and transaction information.
The buyer must state the annotation of “3-year no sale for Turkish citizenship” until midnight of the day 12/06/2022. If the transaction parties don’t change, the conformity certificate process will continue. And the directorate will complete the transaction of over 250,000$.
Missing documents condition
Moreover, if any of the following documents are missing:
- The valuation report
- The currency exchange certificate
- The Bank receipt
The directorate will cancel the application and inform the relevant person. However, in case of deficiency of any other document, the application will continue. Yet, the applicant must submit the missing documents in 20 days. Otherwise, the directorate gives him additional 10 days and informs him through SMS. If not, it will cancel the application.
If the value documents of an application made before 24:00 of June 12th, 2022, are missing; the foreign buyer must prove that he issued the relevant documents before 13/06/2022. In this case, the directorate accepts the process based on 250,000$ regardless of the renewed application date.
Citizenship commitment annotation
A foreign applicant has made the Citizenship commitment and has provided the value of 250,000$ in the conformity certificate process. But other documents are missing. In this case, he can submit the missing documents even after 13/06/2022. And thus he still can get the Turkish Citizenship for 250k$. Moreover, if the commitment is unintentionally removed at this stage, the directorate will renew it and continues the process.
The following conditions require the value 400,000$
The directorate treats the process based on the value of 400,00$ for any application made after midnight of 12/06/2022.
A foreign applicant has made the Citizenship commitment but he didn’t provide the value of 250,000$ at the stage of the conformity certificate. Or if the value-based documents (currency purchase document, valuation report, and receipt are missing; in this case, the directorate will cancel the commitment. Moreover, it will demand a value of 400,000$ for any submission after the date 13/06/2022.
Let’s say a foreign buyer got a preliminary sales contract from the notary and he has registered the sales annotation at the land registry office. However, he didn’t give the citizenship commitment, or he didn’t respect the procedure framework. In this case, if there is no application for these immovables, the applications to be made after 13.06.2022 will require the value of 400,000$
FAQ regarding the new regulation of Turkish Citizenship by Real Estate
Q1: The value of 250,000$ until which date is it valid?
The directorate will accept the value 250,000$ for all applications made until 24:00 of the day 12/06/2022 personally, through webtapu or Alo 180. Otherwise, it will require 400,000$ for any application made after the mentioned date.
Q2: If I apply before 13/06/2022, but some documents are missing, how will the directorate treat my application?
If any of the value-determining documents are missing (currency exchange certificate, valuation report, and bank receipt), the directorate will inform you and cancel the application. However, you can submit any other missing document in 20 days. If not, the directorate will give you additional 10 days and inform you through SMS. Otherwise, it will cancel the application.
Q3: If I applied before 13/06/2022, but some value-determining documents are missing, how will the directorate treat my application after 13/06/2022?
You must prove that you issued the relevant documents before 13/06/2022. In this case, the directorate accepts the process based on 250,000$ regardless of the renewed application date.
Q4: If I have missing documents other than value-determining ones at the stage of conformity certificate, what will be the process?
In this case, you can submit the missing documents even after 13/06/2022 and still can get the Turkish Citizenship for 250k$. Moreover, if you unintentionally remove the commitment at this stage, the directorate will renew it and continues the process.
Q5: If I purchased the property or got a notarized sales promise before 13/06/2022, however, I forgot to mention the commitment of 3-year no sale, can I add it after and still get the Turkish Citizenship for 250,000$?
In this case, if there is no application for these immovables, the applications to be made after 13.06.2022 will consider the value of 400,000$.
